Here is general information about the complaint: Tracking Number: 2000350998 Item Number: 1372555738 Item Description: (not available) Complainant: rlpowell@digitalkingdom.org (rlpowell@digitalkingdom.org) Against: an chin DIECAST2NR@FLAREX.COM Web Site: ebay.com Date Complaint Filed: Sep-25-02 11:04:45 PDT Purchase date: Aug-11-02 11:29:05 PDT Nature of Complaint: I sent a payment and received the merchandise, but the merchandise is different than the seller described it. The following are ALL of the comments provided to the Fraud Reporting System regarding this complaint: 09/25/2002 11:05 AM - FROM: rlpowell@digitalkingdom.org -------------------------------------- The item is not what it was claimed to be. I have e-mails documenting my discussion with Red Octane confirming that the item in question is *not* an Ignition 2.0 pad. I also have e-mail from my discussion with diecast-tuners in which ey admits, "The pad you recieved does NOT have a logo but exactly the same as the "official" pad." I ordered, and paid for, an *official* Red Octane 2.0 pad. In addition, there are actual functional differences (the semi-circular section of pad closest to the center does not register steps, which the 2.0 pad does). diecast-tuners has refused to listen to my complaints. Looking through eir feedback, this looks like it has happened a couple of times before. E-mail documentation available upon request. 09/25/2002 02:24 PM - FROM: diecast-tuners -------------------------------------- Offered customer full refund if item was not to his satisfaction. FULL Refund would be given upon recieving item in it's orignal Brand New Condition. 09/25/2002 02:35 PM - FROM: rlpowell@digitalkingdom.org -------------------------------------- You most certainly offered no such thing. I just searched all of the e-mails you sent me (and as I run my own server, I can provide logs to this effect). The last e-mail you sent me is as follows, not counting quoted pieces: - ------- You got exactly what you placed for. Please contact Ebay because it's people like yourself that does not read a product DESCRIPTION before you bid. The Ignition 1.0 has a piece of SOFT not DENSE white foam in it. Ignition 2.0 has the DENSE foam, get more facts before you start something which you do not know. Do what you want, you got exactly what was described. AGAIN IGNITION 1.0 (SOFT WHITE FOAM) IGNITION 2.0 (DENSE BLACK FOAM) Contact redoctane and confirm! Stop wasting my time with these assumptions. - ------ Not only is that not a refund offer, it doesn't even show basic politeness. -Robin 09/25/2002 03:11 PM - FROM: diecast-tuners -------------------------------------- Again, we've contacted this buyer regarding this matter and was settled prior to complaint. Her'e the copy of email sent 9/3/2002. : Date: Tue, 3 Sep 2002 09:32:47 -0700 (PDT) From: "DIECAST-TUNERS" | This is Spam | Add to Address Book Subject: Re: Ignition Pad To: "ATF" I will refund the FULL amount (inclding shipping) if the item is recieved back to me in its ORIGNAL UNUSED BRAND NEW CONDITION. If the pad is not in resalable condiditon, then I cannot refund the amount. Once I recieve the item back, I will refund the amount in full. Meaning you will be responsible for shipping the pad back to me. And once the pad is recieved, I will refund the full amount to you. AC 09/25/2002 03:17 PM - FROM: rlpowell@digitalkingdom.org -------------------------------------- default 09/25/2002 03:26 PM - FROM: rlpowell@digitalkingdom.org -------------------------------------- I'm not ATF! I'm also not . So apparently I'm not the first person who has complained about you pulling this stunt. You didn't send that mail to me, you sent it to someone else who complained. Busted. -Robin 09/25/2002 03:32 PM - FROM: diecast-tuners -------------------------------------- Same will apply... the offer stand and it's up to the buyer to take it up. We will refund in FULL if the item is returned in it's ORIGINAL UNUSED CONDITION. We have the asme policies for everyone. This proves we do take CARE OF ISSUES SUCH AS THIS! 09/25/2002 03:43 PM - FROM: rlpowell@digitalkingdom.org -------------------------------------- I'm sorry, but you never sent me such an offer. Ever. I have the server logs and e-mail logs to prove it. If e-bay wants those, they can ask for them. But that's not even the point. The point is that you are *still* selling the *same* item, and making the *same* lies about it. See http://cgi.ebay.com/ws/eBayISAPI.dll?ViewItem&item=1382407800 ----- Right in there you say: "1. Arcade sized circuitry for arcade level scores". This is a lie. I have the pad you sold, and this is simply not true. ---- I don't care about a refund, I care about you stopping your lies to other e-bay users. -Robin 09/25/2002 10:08 PM - FROM: diecast-tuners -------------------------------------- Funny how you forget how you complained just about everything. On top on this you sent another email complaing about shipping charges. Then you state it's not a Ignition 2.0 dance pad. Those were all terms of the auction. The person RECIEVED AN IGNITION 2.0 Dance Pad. Everything stands as stated. It is arcade sized to the arcade machine (which varies in size from machine to machine). Again customer recieved everything as stated. 09/26/2002 10:28 AM - FROM: rlpowell@digitalkingdom.org -------------------------------------- Whatever. You charged 15$ more than FedEx ground quoted me for the same shipment. I can prove everything I say. I am no longer interested in discussing this with you. I will wait for e-bay's official response. -Robin 09/26/2002 11:00 AM - FROM: diecast-tuners -------------------------------------- I rest my case. The customer till now still complaining about the shipping. I will gladly like to see the result from ebay as well.
